DMCA Policy

Triple Berry Sauce Recipe respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond promptly to notices of alleged copyright infringement that are reported to our Designated Copyright Agent, identified below.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Triple Berry Sauce Recipe site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Triple Berry Sauce Recipe will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the site.

  1. Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by this Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  3. Provide information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
  4. Include the following statement: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  5. Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Provide your full legal name and your electronic or physical signature.
  7. Send the written infringement notice to our Designated Copyright Agent via our contact page.

DMCA Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our Designated Copyright Agent:

  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.
  • A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in [Your State/Region, e.g., the U.S. District Court for the Northern District of California] and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
  • Your electronic or physical signature.
  • Send the counter-notice to our Designated Copyright Agent via our contact page.

Upon receipt of a valid counter-notification, Triple Berry Sauce Recipe may, in its sole discretion, reinstate the removed content. Please be aware that if you knowingly materially misrepresent that material or activity was removed or disabled by mistake or misidentification, you may be liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.
